Landlord’s Voting rights after the Right To Manage

March 9th, 2010 by admin

Under the 2002 Commonhold and Leasehold Reform Act, the landlord has the right to become a member of the RTM company and have a vote. Often there is some concern as to how many votes the landlord is entitled to after a Right To Manage has been completed. In the most common case, where the landlord owns no units, he/she is allocated one vote. In the case where the landlord owns say two units, he/she will only receive two votes. (the landlord would not get an extra vote as landlord status, as he/she already has voting rights from the two flats).

So in most cases any concern about residents being outvoted by a landlord is unwarranted.
